Solved unable to load toshiba recovery disk

Specs: Windows 7
I created a Toshiba recovery usb flash drive. it boots fine. when I try to load a full factory recovery to a new hard drive it fails with error 09-130-0020. New HDD is WD sata drive that is smaller than the factory installed hdd

Turns out the problem was that the target disk had more than 2 partitions. In the first phase of the restore it attempts to reformat the target disk and for whatever reason cannot if it has more than 2 partitions. I wiped the disk clean then reran the restore with out problems.

The size of the target can be smaller than the original, just has to be able to hold the target and temp files.
