Are you sure it's My Documents, and not Documents?

Drop the trailing \ from the source.

Helping others achieve escape felicity

This Worked:
xcopy "C:\Users\Jason\Documents" "C:\Backup\" /c/y/h/s /D:03-01-10

For anyone interested, It Shows up in explorer as \My Documents\ but when you right-click properties the correct path is shown under network path.

Thanks the help
