Recover them from iTunes or iCloud if you backed them up. If you didn't, well you've only yourself to blame for that.

Yes, you are right! so it is important to do a backup avoiding to lost them when we upgrade it or jailbreak.....check the backup by doing this:
Launch iTunes
iTunes > Preferences > Devices

There are some other methods to choose.
If you have ever backup data by iTunes or iCloud. You can get back deleted photos through iTunes or iCloud.
