I have changed my modem several times with freinds currently I am using an intel ham data fax modem and it is connected to com 3.

Same problem here. Tried an Intel HaM 56, thought it was the modem so bought a Creative Modemblaster v92 and got the same problem. Seems it's to do with the way XP allocates an IRQ to your modem (in my case 16-18 depending on the PCI slot used). The documentation that came with the modem suggests that it is actualy configured for IRQ 1- 15. Have tried changing it but the option is "greyed" in the device manager.

I've read on here that it may be possible to manually configure the IRQ by resetting your PC to HAL (not ACPI) so I'm off to meddle with my BIOS.......

If it works I shall let you know (you may also see me finally throw out the Diamond Supra ISA modem I'm using to access this site right now......)
