Open Windows Explorer,
do you see it in the Folder's list in the lefthand pane ??

Or do you see it in the righthand pane, when you click Desktop that is in the lefthand pane ?

Also thinking maybe that Icon is on top of or under another icon.

Right click the Desktop,
point to "Arrange Icons By",
then click "Align to Grid"

yeah its over on the left hand side folder list, however the only way I can get it to the desktop is by a shortcut, which works but still seems...off. And lastly my icons are already aligned to grid.

haha, its funny when I was trying to get a screen shot of the explorer window showing that I had reycle bin in my desktop but it wasnt there, I pasted the SS into photoshop where it showed an entire right screen that wasnt there. Turns out I accidently turned on that setting in Nview that lets you put multiple moniters set up in a cross screen fashion, it thought my TV which isnt hooked up right now was the right half of the screen. heh, thanks for all your help anyways!

On Web search found this-
Are you using TweakUI, you can hide the Recycle Bin on the Desktop in
the "Desktop" tab settings of TweakUI, re-tick the Recycle Bin entry, click Apply
and OK, it to unhide it.
