Time computers and valid XP?

I've just been to see a 'Time' branded computer which has fallen foul of the Windows Genuine Advantage pop-ups. This guy bought the PC direct from Time before they went bust obviously & it came with a recovery CD with XP Home emblasoned on it. There's no holographic sticker anywhere on the case but he's adamant that it came pre-installed & exactly as it was. So firstly, is there any way he can prove to M$ that he has a 'legal' copy of XP or is it a case of 'tough luck'? & secondly has anyone else come across branded systems which appear to have non-legal copies installed?
