nero ask for double layer

I am trying to copy a dvd with nero express, let me tell what I did: I inserted the dvd into the drive, and open nero express 6.3, and select copy entire disk, it created a imagem to burn like usual and opened the drive tray and ask for double layer disk. The disk I am trying to copy has only 1.7 gb, and it should fit in the 4.7 gb disk. Why did ask for double layer? Any help will be appreciated.
Summary: Yes thats legal, but the dvd people dont like it. the pioneer drive burns double layer...right? all i can say is try a different program. My experiences from nero arnt good. Maybe give alchoal 120%...
Summary: I have tried removing and reinstalling. I device manager the drive shows OK. Nero recognises that it is a Cd-RW. The only thing is that when I reboot it asks for a driver each time. It is just a pain....
