i remember seeing an option somewhere in windows to disable always on top for folders, but i cant remember where i saw it.
when i have a folder open, clicking on the desktop will not minimize the folder. only by clicking on the minimize icon will do this. anyone know how to stop this?

I don't know the option that you saw Someone else might be able to help you. Anyways, you can just click Show desktop Icon on Quick launch bar

Some applets have an option "always on top", however not Windows folders. With a folder open, but not maximized, then clicking on the Desktop will not minimize the folder to the taskbar.
Clicking on your Desktop as you describe makes the Desktop active and the open folder inactive, although you can still see the folder it will not minimize the folder automatically.
Available folder options can be changed in Control Panel > Folder Options
