Acer notebook not staying in sleep mode?

I've had a couple of problems with this laptop. I don't know if it's vista that is causing the problem, or if it is the laptop itself.
A lot of time, when I put my computer on sleep (or if I just shut it), it will stay asleep for a little while, then turn on by itself. So, the fan is going and the laptop itself is running the whole night. I disabled all virus scans and spyware scans (stuff like that) that might be doing a scan in the middle of the night, but that didn't fix my problem. I can't figure out what it is... any ideas?

Another thing, is that when I do open up my laptop (usually when it's either been asleep or closed over night) sometimes I cannot type my password in to sign onto my account. It will not let me type at all, and sometimes it won't even let me move the cursor. The only fix is by turning the laptop off manually, and I don't feel that this is good to do so often. Can someone please give me an idea of what is going on and how to repair it?

I received my windows 7 update in the mail the other day. I haven't updated to it yet, but do you think this would be a fix?

If this is a new notebook and still in warranty, then let Tech people at Acer deal with your problem.

If you want to solve the problem yourself, which is the best way to learn about how to solve computer problems, then look into BIOS for settings that wake up your PC from sleep.

Some of the wake-up options may be, timed wake-up, wake-up by LAN, wake-up by mouse, if you have one, etc.

Also check your LAN card settings in Device Manager. It may trigger wake-up when an e-mail comes to you.

These settings may be under Power Management or Advanced.
