I am replacing a server, I have the option to buy the new server with Windows 2003 server, however the old server has Windows 2003 on it already. Can I just install it on the new server and use the old product key? Is this legal?

Probably not - MOST of the time, when people buy servers, they get them with Windows - these licenses of windows are typically OEM licenses with live and die with the hardware they are sold with. If you attempted to install an OEM version from one system on another, then you would be violating licensing.

IF you have a volume license agreement, then THAT would allow you to transfer the license.

I agree.. it just depends how you purchased your existing license. Do you remember? Do you order it from a vendor like CDW or did it come with the machine?

If you call Microsoft, they might be able to tell you based on your existing key.
