Here is my problem we are migrating from windows 2000 to windows 2003 i want to transfer users folders from the old domain controller to the new domain controller without losing permissions on the users respective folders how would i go about accomplishing this?

that wouldnt help because i am not upgrading my domain controller we have a fresh 2003 box that we are using i just want to move the romaing profiles from a share on the windows2000 dc to a share on the windows2003 domain controller without losing the file permissions associated with the users respective folders.

That isn't what he is asking. He is asking how to move files and retain permissions.

DJones, you can move files and retain permissions during the copy by using robocopy. It is a Microsoft tool included in the resource kit and downloadable as a stand along tool.

The problem is, you say you have a 'fresh' install of a 2003 domain, not an upgrade. Were these users all created new as well? If so, the new domain will not recognize the users from the other domain even it they have the same name. You don't really give enough information to answer this.

If you user accounts were migrated, or if you have a trust between two domains, this should work. But to answer your original question, robocopy will do what you ask.
