What is the ethics for buying a machine that has an o/s on it? If I buy a used machine that has a operating system, at that point does it become my property? If not how could I check the legitimacy of a used machine? Where is the happy middle ground?

If you buy a USED machine with the OS on it you also need to get all the installation software and agreement paperwork. Technically they need to make sure you have every little thing, but I think it's ok as long as you have the official CDs that go with the machine and the accompanying official CD Key (most were on the manuals or on a sticker on the machine itself, it should say "Certificate of Authenticity"). If they give you a copy of the OS installation CD that they burned, that's not acceptable.....

According to Microsoft, you do NOT own the operating system software. You are paying for a liscense to USE it.

Linux on the other hand is free for use without a liscense.
