SCO's complaint isn't against AIX, which is not "open source." SCO claims that IBM allowed SCO IP to be incorporated into Linux. I don't know what their latest track is, but this originally started over 3 things. Incorporation of Read, Copy, Update in thread support, incorporation of NUMA technology and JFS. SCO calls these derivative works and claimed they were covered under the licensing agreement as part of SCO IP. JFS is the journaled file system which was originally developed by IBM and has been part of AIX since 1990 (perhaps earlier). Read, copy, update thread support was developed by Sequent Computer System as was NUMA (Non-uniform Memory Access) as part of the Dynix operating system. IBM purchased Sequent in 1999 and therefore gained all the Sequent IP. Dynix was a unix based OS and therefore was licensed from Novell (at that time) and AT&T prior to that.

The group that purchased SCO is the same one that purchased Digital Research. They went on to sue (successfully) Microsoft for changing API's and other things so Windows would not run properly under DRDOS. Their case against Microsoft was fairly solid, which is why they won. There case against IBM is weak and I think Big Blue will hand them their heads in a basket before this is all over. Given that SCO's stock was trading at $.072 a share in 2002, they needed to do something to get their stock price up.

The above is my best understanding of the events thus far. A good site to follow this matter is www.groklaw.new
