According to a story in The Register:

"Overstock.com is set to become the first company to take action under Utah's new anti-spyware law. The company has filed a complaint against online retailer SmartBargains in the third district court in Salt Lake City. Utah's spyware law, the world's first, only made the statute book on 3 May. Utah is the only state with current spyware legislation, although California and Iowa are considering their own versions of the law."

A good beginning, but still the question of jurisdiction hasn't been solved, so I foresee limited effect. You can't proceed against someone beyond the State borders, especially foreign locales. This isn't going to be solved by legislating in one State in one country, it needs national level laws around the world and international co-operation.

The U.S. is a little ahead of us here in Canada. We don't yet have any spyware laws. Last week they were talking on the news of taking action against spam however the action was to set up a committee to study the problem. We prob. won't have any laws till Windows Longhorn gets released.
