Can't trash .cgi files

I have some Stuffit partial files (.cgi) on my desk top that I can't get rid of. When I try to trash them it says the item is being used by another task right now. I have now clue as to what the other task might be. How do I delete these files?

Have come across this. An Apple technician told me what to do. It worked!
1. Boot up in Classic (OS 9) 2. Users Folder (OS X) 3. Look for your named folder and open it at the desktop file. 4. Drag the offending item to trash, empty it, and reboot.
