SMART failure but drive is fine....

I have a Maxtor 40 GB 7200RPM and it is having SMART failure. No big deal all backed up, however I used the Maxtor software and it said the drive was fine. I used the recertification and low level format and burn in test all passed with no bad sectors WTF! Am I safe to use this drive or should I just throw it out?

S.M.A.R.T is not dumb. It monitors a number of drive parameters, and it's main purpose is to give you warning that something important is starting to not work right.
