Laptop freeze then fan?

Ive bought a new Acer Aspire 1315LM Laptop, works fine on mains power, as soon as its disconnected the fan hardly comes on. It does for a few seconds whenever I first switch it on then i feel it getting warmer and warmer. In an hours use, it will kick in about twice but again only for 10 seconds each time.
Then the screen will "off-set" slightly, and freeze completely, THEN the fan switches ON! I have to remove the battery to reset it.
I notice the base gets very hot at this point, especially where the memory plate is.
Is this a hardware or BIOS problem? and can it be rectified?
I would like to rectify this problem as it can be very annoying.

The fan going off when you pull the power cord is not in itself a problem. That will happend as the CPU will automatically go into low power mode, therfore generating less heat.

However the subsequent problems suggest a faulty battery or the battery monitoring hardware is not working properly. If that is the case do what Lou suggests and take it back.
