Female usb slot brocken

The mini female usb slot on my iomega 500gb portable hard drive has fallen into hard drive when i went to plug it in.
It was bought from comet last year ,they will replace it but not recover the data.
Who is responsible for repair and recovery of data.

They're not responsible for your data. If it's that important, you should have had a 2nd backup. Why can't you fix the USB port? or at least open the case, retreive the data from the HDD, THEN have the unit replaced?
