cmos battery

recently i've been getting warnings about a low cmos battery, and checksum errors. i go into the BIOS and set it up as per my req's, since it loses all the settings upon powering down, and all is ok until i cold boot, where as this happens again. if i just reboot from the start menu, it reboots ok. this mobo is only 6 weeks old, it's an ECS K7S5A Pro with an AMIBIOS. i've also noticed that my hdd activity light sometimes stays on constantly, so i'm assuming the hdd is spinning more than seems necessary. is it possibly more than a low cmos battery? maybe a faulty mobo?
