Brand new DVD RW drive won't open

Specs: Windows 7, i7 950
I just brought home a custom built pc and am ready to install Windows 7 on it. BIOS asks for the disc, but when I push the eject button nothing happens. The drive looks inactive, no lights at all even at power-up. I took the panel off, it's got power and sata to it.

This has to be a hardware issue, right? IE a defective optical drive?

With no way to get the disc in the drive, this is a very frustrating new toy! Any suggestions?

Yeah, I'd think it was defective. But after you turn on the PC hit the PAUSE/BREAK key to stop the posting process. That way you'll know nothing is interferring with the DVD. Then see if the button works.
