my 56k modem sometimes reaches speeds of 30 -40kbs..Is it possible to alter the frequency on a modem to sustain that speed? Or is it solely ISP controlled?

Its a combination of your ISP and phone lines. There is nothing on your end that would help.
Chances are its the phone lines that limit your speed. Pick up the phone and dial 1. If you hear any noise it's the line either inside or outside the home.

As Jimi says,it is a combination of ISP and phone lines.Another factor is whether your modem is internal or external.External typically will give you better connect speed and download speed. Regarding phone lines:The closer you are to the telco main office(fewer loops to go through)the better your performance. My laptop typically connects from home at 37.If I move it to a location closer to the telco office,it will connect at 51
Again as Jimi says, your ISP is a factor. For instance if your modem is V90/92 you should be using a dial in # from your ISP that supports this protacol.likewise if it is 56kflex,call in on a # that supports this protacol
