Trouble with 'Mafia'

alright, for some reason mafia will act like its skipping frames every second and a half, its like the frame just isnt there. i know its not my hardware (see list below). the sound doesnt skip, just the video. i've tried turning every setting down to it's lowest including in the game and the ati control panel as well as the audio. i dont know what it is, but its annoying and i love this game.
Hardware: Pentium 4 2.54ghz 512MB DDR RAM ATI Radeon 9600XT 128MB(built by ATI) Newest Drivers (problem existed even before I got the newest drivers) onboard audio
Also, no other games have this problem with Direct3D or OpenGL.

My disc came with version 1.2. There's nothing more recent than that....I really want this fixed..
